Terms and Conditions

1. General
1.1 You (the end user) may only acces games developed/published by Zeonium Games SRL ("us") if you are above the age of 13, unless you live in the European Economic Area, where our apps are limited to individuals aged 16 or above. By downloading, installing, opening or using any of our apps you warrant that you are above the age specified above.
1.2 You may only download our games from official stores (Google Play Store/App Store).
1.3 You must always use the latest version of our games. We are not liable for any direct or indirect damage that might incur because of the usage of an outdated version of the our app(s).
1.4 If, because of applicable law, one or more of this agreement's terms is void or becomes void or inapplicable, this will not affect the rest of this agreement. Such term(s) will be substituted with another term that has a similar meaning or one that produces a similar economic impact, where possible.
1.5 You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

2. Usage
You are allowed to use our applications in compliance with each app's End User License Agreement (EULA):
2. Liability
2.1 Our games are offered on an “as is” and “as available” basis, “with all faults” and without any implicit or explicit warranty. We are not liable for any damage derived from downloading, installing or using our software programs, and we are not liable for any errors in the content presented, or for the information provided being accurate, complete, or suitable for any purpose. To the fullest extent of the applicable law, in no event shall we or the company’s owner(s), administrator(s) or employee(s) be liable for any personal injury, property damage, loss of data, device or operating system failure caused by or related to the usage of our apps.
2.2 Our games might contain advertisements or links to other websites. We are not liable nor responsible for any losses/damages caused by those third parties, nor for any omissions/errors related to our ads or the to the displayed content.
2.3 Our games may include the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Zeonium Games SRL, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials. Without limiting the generality of the foregoing, Zeonium Games SRL, Epic, and Epic’s affiliates make no warranty that any of the Epic Materials will operate properly, including as integrated in the games provided by Zeonium Games SRL, that the Epic Materials will meet your requirements, that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, that any defects in the Epic Materials can or will be corrected, that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or that a platform manufacturer has approved or will approve the software provided by Zeonium Games, or will not revoke approval of such software for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by us or Epic, and our or Epic’s affiliates do not guarantee continuous, error-free or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
2.4 To the maximum extent permitted by applicable law, neither us, Epic, Epic’s licensors, nor its or their affiliates, nor any of our or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Zeonium Games, Epic, Epic’s licensors, nor its or their affiliates, nor any of Zeonium Games's or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this agreement or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Zeonium Games's, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Zeonium Games, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Zeonium Games, Epic, Epic’s licensors, its and their affiliates, and any of Zeonium Games’s or Epic’s service providers shall be limited to the full extent permitted by law.
3. Copyright
3.1 Our games and their original content, including but not limited to our code, features, images, designs, logos, 3D assets and characters are owned by Zeonium Games SRL and are protected by international copyright law.
3.2 Unauthorized selling, redistributing or copying any of our games or any of our games’s files is strictly prohibited.
3.3 Modifying, reverse engineering, decompiling, disassembling the game, as well as creating derivative works is strictly prohibited.
3.4 Any other unauthorized use of our Intellectual Property is prohibited.
3.5 Our games may use Unreal® Engine. Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States of America and elsewhere.
4. Purchases
4.1 Our apps might contain optional in-app purchases. Those purchases are only available for users that are above the age of 18 and for users under the age of 18 that have consent from a parent/legal guardian to make the purchase. By making a purchase you warrant that you are allowed to make that purchase.
4.1 All purchases are final and non-refoundable, except as required by law.
4.2 You agree that the virtual items you purchase have no monetary value and do not constitute property.
4.3 Purchases are final, and no refunds will be issued once you make a purchase.
4.4 If you are a citizen of the European Union, you have certain rights to withdraw from online purchases. However, please note that once you recive the purchased items your right of withdrawal ends. The purchased items are delivered instantly after you approve the transaction.

5. Privacy
By agreeing to these terms you also confirm that you have read and understood our Privacy Policy and you consent to our usage of your data in compliance with this Policy.
6. Revision
6.1 We may, at our sole discretion, at any time, for any reason, revise those terms.
6.2 The new terms and conditions apply imediately once they are published.
6.3 We will notify the user about any changes by modifying the date at the top of this document.
6.4 The most recent version of this document is the version that can be found on our website, at zeonium.com
6.5 If you not agree to our new or revised terms, you must uninstall our application(s).

7. Termination
7.1 We reserve the right to suspend your access to our games at any time for any reason.
7.2 You will not recive any compensation for the items you purchased if your access to our games is suspended.

8. Governing law
8.1 These terms and conditions are governed by the laws of Romania.
8.2 All disputes in connection to this document shall be settled by court in Romania, under the Romanian law.
